Abstract

This paper aims to delineate the contours of the concept of political justice in Otto Kirchheimer's work. It is inserted in the scenario of intense problematization of the relationship between law and politics, while seeking to address the scarcity of Brazilian literature on the topic from the perspective of political justice. To achieve this goal, the author's thought and the theoretical foundations of his production will be investigated. Next, the concept of political justice and its subclasses as presented by Otto Kirchheimer will be explored. Finally, the concept of political justice will be confronted with lawfare - a concept more widely disseminated in specialized literature and in the brazilian public debate and which approaches it without being confused with it - identifying the similarities and differences that it maintains with it. At the end of this work, a typology of political justice is presented and the challenge it poses to contemporary constitutional democracies in guaranteeing the coexistence of political dissensions is noted.

Possui Graduação (1990) e Especialização (2001) em Direito e Cidadania pela Universidade Federal do Rio Grande do Norte; Especialização em Direito Penal, Compliance e Law Enforcement (2018), pela Faculdade de Direito da Universidade de Lisboa (FDUL, 2018); Mestrado (2003) e Doutorado (2006) em Direito Constitucional pela Pontifícia Universidade Católica de São Paulo; Pós-Doutorado (2018) em Direito Constitucional pela Faculdade de Direito da Universidade de Lisboa. Atualmente é Professor Titular da UFRN, lotado no Departamento de Direito Público dos Cursos de Graduação e do Programa de Pós-graduação em Direito (Lato e Stricto Sensu); Membro do Colegiado do Curso de Direito da UFRN (2021-2023); Coordenador na Escola da Magistratura do RN;  Juiz de Direito.
