PROPOSTA DE DESPERSONALIZAÇÃO DO PROCESSO DECISÓRIO DA SUPREMA CORTE BRASILEIRA

Abstract

The Supreme Court of the United States of America played a fundamental role in the establishment of judicial review, influencing the process of creation of several Supreme Courts around the world, among them the Brazilian Supreme Court. Using the historical study of the Supreme Court of the United States of America, this article discusses the importance of John Marshall's adoption of the opinion of the Court to establish its legitimacy and addresses contemporary studies on legitimacy crises of its decisions. The article also performs a historical study of the Brazilian Supreme Court, addressing its creation, development and the crisis of legitimacy of its decisions, expressed by the individualism of its members in the exercise of seriatim practice. It suggests a possibility of re-approximation of the Brazilian Supreme Court to the Supreme Court of the United States of America through the adoption of the opinion of the Court in Brazil as a as a way of depersonalizing its decision-making procedure and ensuring institutional understanding of the matter decided.

Professor Titular de Direito Constitucional da PUC-Campinas. Doutor e Mestre em Direito Constitucional pela Instituição Toledo de Ensino. Mestre em Direito Processual Civil e Bacharel em Direito pela PUC-Campinas. Membro do PPGD da PUC-Campinas. Foi Diretor da Faculdade de Direito da PUC-Campinas de 01 de fevereiro de 2010 a 31 de janeiro de 2018. Membro do Grupo de Pesquisa Saúde, Direitos Humanos e Vulnerabilidades (CNPq/PUC-Campinas), com atuação na Linha de Pesquisa Cooperação Internacional e Direitos Humanos. Membro da Diretoria do Research Committee (RC09) - Comparative Judicial Studies - da International Political Science Association (IPSA). Possui pós-doutoramento pelo Departamento de Direito de Estado da Faculdade de Direito da USP, sob supervisão do professor Conrado Hübner Mendes. Visiting Sholar na Washinton University in St. Louis, sob supervisão da professora Lee Epstein, na Northeastern University sob supervisão do professor Michael Tolley e na University of Houston, sob supervisão da professora Lydia Tiede. Advogado com atuação em Direito Público. Secretário de Justiça de Campinas -SP.
