Abstract

Economic regulation through sanctioning practices has been influenced by a more functional and efficiency-oriented perspective, further moved by consensual decision-making. One of its consequences is the dissemination of Conduct Adjustment Commitments in public entities responsible for regulating different aspects of the economy. This paper intends to analyze the use of such Commitments by regulatory agencies in the area of infrastructure, with the goal of understanding the obstacles to their celebration and possible paths towards improvement. In this sense, CADE represents a positive example with the successful use of Commitments as an antitrust tool. That’s is why it was chosen as the benchmark through which the regulatory agencies would be compared.
